SMS Terms of Service
These SMS Terms describe the PopOnBy Sunday Brief text-messaging program. By opting in, you agree to these terms. If you have questions, email hello@poponby.org.
Program description
The PopOnBy Sunday Brief is a recurring text message we send to opted-in community members with a personalized weekly digest of local events, deals, and community notices happening in their town. Sunday Brief content covers only local events, deals, and notices from organizations and businesses on the PopOnBy platform. We will not use this program to send marketing messages on behalf of unaffiliated third parties.
This program is operated by Zazz Creations LLC ("PopOnBy"). Messages may be sent using automated dialing technology.
How to opt in
You can opt in to receive the Sunday Brief by:
- Checking the consent box during PopOnBy account setup and tapping Sign me up, or
- Turning on the Sunday Brief toggle in your account settings within the PopOnBy app
When you opt in, you will see the following:
By checking this box, you agree to receive PopOnBy's weekly Sunday Brief at the number provided. Consent is not a condition of any purchase. Message and data rates may apply. Reply HELP for help, STOP to cancel.
We record the date and time of your opt-in, the consent language you agreed to, and your IP address and browser at the moment of consent, as a legal record. Your electronic acceptance of this consent constitutes your signature and your affirmative consent under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
Message frequency
Typically one (1) message per week, sent on Sundays. Frequency may vary.
Message and data rates
Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to any messages sent or received. Check with your carrier for details.
Transactional vs marketing messages
The Sunday Brief is a marketing/promotional program governed by these terms. Separately, PopOnBy may send you transactional messages (such as one-time login verification codes) that are necessary to operate your account and are not governed by your marketing-SMS consent. Opting out of the Sunday Brief does not affect transactional messages, which you will continue to receive as long as you have an active account.
How to stop messages (opt out)
You can stop receiving Sunday Brief messages at any time by:
- Replying STOP to any PopOnBy Sunday Brief text, OR
- Turning off the Sunday Brief toggle in your account settings within the PopOnBy app.
After you reply STOP, you will receive one final confirmation message and no further marketing texts from PopOnBy.
To resume Sunday Brief messages after opting out, reply START to the most recent text, or turn the Sunday Brief toggle back on in your account settings.

Supported carriers
The Sunday Brief is available on most US wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, Boost, MetroPCS, U.S. Cellular, Cricket Wireless, and others.
Carriers are not liable for delayed or undelivered messages.
Privacy
We handle your phone number and consent information as described in our Privacy Policy. We do not share your phone number or opt-in information with third parties for marketing purposes. We use Twilio as our service provider to deliver these messages.
Legal compliance
We intend for this program to comply with the federal Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and other applicable laws and regulations governing text messaging.
Changes to these terms
If we materially change the SMS program (such as message frequency or content type), we will update these terms and notify opted-in community members before the change takes effect.
